By purchasing, accessing, or participating in any Earthkey Media product, service, or digital resource Services , you Client agree to be legally bound by these Terms & Conditions. Please read them carefully before completing any purchase or accessing any content.
If you do not agree to these Terms in their entirety, you must not purchase, access, or use any Earthkey Media Services.

These Terms apply to all Earthkey Media, Earthkey OÜ offerings, including but not limited to: social media management services, branding services and templates, e-book products, and any consulting or strategy sessions.
Where a specific Service has additional terms communicated at checkout or via a separate service brief, those terms operate alongside these Terms. Where there is a conflict, the more specific terms for that Service will control.
You confirm that you have read, understood, and agreed to be legally bound by these Terms by proceeding with any payment or accessing any content.

EarthKey Media currently offers the following categories of Services:
2.1 Social Media Management Packages. Standard. Growth. Premium.
Ongoing or project-based management of your social media presence, including content planning, strategy planning, scheduling, and posting across agreed platforms. Scope, deliverables, posting frequency, and platforms are confirmed in accordance to our packages or agreed in writing prior to or at the start of each engagement.
2.2 Branding Services.
Visual identity, brand strategy, and creative direction services. Specific deliverables (brand guidelines, color palettes, typography systems, etc.) are agreed in writing before work begins. Revisions are limited to the number stated in your service agreement or checkout confirmation.
2.3 Notion System/Templates. Intentional Social Media Planner
A digital Notion template and planning system designed to help you build a simple, intentional social media strategy. Delivered digitally upon purchase through email or drive link. This is a self-use template and does not include live coaching or ongoing support unless expressly stated.
2.4 E-Book Products
Downloadable digital publications on topics related to social media strategy, content planning, and intentional business building. Delivered instantly or within 24 hours of purchase. E-book purchases are for single personal or internal business use only.
2.5 Consulting & Strategy Sessions
One-off or packaged strategy calls to support your social media or branding direction. Session details, duration, and deliverables are confirmed at the time of booking. Session recordings may be provided at EarthKey Media’s discretion.

3.1 Ownership
Earthkey Media retains all copyright, trademark, and intellectual property rights in all original materials, systems, frameworks, templates, e-books, visual assets, copy, strategies, and methodologies created in connection with the Services – including the Notion systems sent to you and all related resources.
Nothing in these Terms transfers ownership of any intellectual property from Earthkey Media to you. All rights not expressly granted are reserved.
3.2 License Grant – Digital Products & Templates
Upon purchase, Earthkey Media grants you a limited, non-exclusive, non-transferable, revocable licence to use purchased digital products (including the Notion system, templates, and e-books) solely for your own personal or internal business use.
3.3 Ownership of Deliverables – Done-For-You Services
For branding and social media management services, full ownership of final agreed deliverables transfers to you upon receipt of payment in full. Earthkey Media retains the right to display the work in its portfolio and marketing materials unless you request otherwise in writing.
Ownership of deliverables does not transfer until all outstanding invoices are paid in full.
3.4 Prohibited Uses
Without prior written consent from Earthkey Media, you may not:
- Copy, reproduce, redistribute, or resell any Earthkey Media template, e-book, system, or framework
- Share purchased digital products with anyone who has not purchased them
- Incorporate Earthkey Media materials into products, courses, or services for resale or client delivery
- Claim authorship of Earthkey Media content, systems, or templates
- Share login credentials or access links with any other person or entity
3.5 Enforcement
Any violation of this Section may result in immediate access revocation without refund and may result in legal action to pursue all available remedies.

4.1 Payment Authorization
By completing a purchase, you authorize Earthkey Media to process the full transaction amount or recurring charges according to the payment terms displayed at checkout or in invoice sent to you. All prices are quoted in EUR / GBP e.g. unless otherwise specified.
4.2 Recurring & Retainer Payments
Where you engage Earthkey Media on a retainer or monthly service basis, payments are due on the date agreed at the start of the engagement. You authorize automatic recurring charges to your payment method for the agreed billing period. Retainers are payable in advance of the service period.
4.3 Payment Plans
Where a payment plan is offered at checkout:
- All instalments must be paid in full regardless of your level of participation or satisfaction
- You authorize automatic charges to your payment method per the agreed schedule
- Failed payments must be resolved within five (5) calendar days of notice; continued non-payment may result in access suspension and the outstanding balance being referred to collections
- Suspension or termination for non-payment does not cancel your obligation to complete the payment plan
4.4 Late Payments
Overdue invoices not remedied within the grace period may result in suspension of Services, withholding of deliverables, and/or pursuit of the outstanding balance through legal means. Earthkey Media reserves the right to charge statutory interest on overdue amounts in accordance with applicable EU/UK late payment legislation.
4.5 No Withholding
You may not withhold or offset payments for any reason, including dissatisfaction or delivery disputes, unless expressly required by applicable law.
4.6 Chargebacks
Before initiating a chargeback with your bank or payment provider, you must email info@earthkeymedia.com and allow seven (7) business days for resolution. Unwarranted chargebacks where Services have been delivered are a material breach of these Terms and may result in immediate termination of all Services, dispute of the chargeback with full documentation, and recovery of any associated fees or damages.
4.7 Taxes & VAT
Where applicable, VAT or other applicable taxes will be added to the price displayed at checkout and shown on your invoice. You are responsible for any additional taxes applicable in your jurisdiction.

5.1 General Policy
All sales are final and non-refundable unless a conditional guarantee applies as described in Section 5.2 below, or as required by applicable EU/UK consumer protection law.
EU/UK Consumer Right to Withdraw: If you are a consumer based in the European Union or United Kingdom and purchase a digital product, you have a statutory right to withdraw from the contract within 14 days of purchase, unless you have expressly consented to immediate delivery and acknowledged that you lose your right of withdrawal upon access. By accessing or downloading a digital product immediately after purchase, you expressly consent to immediate performance and acknowledge that your right of withdrawal is lost. This does not affect your rights in relation to faulty or misdescribed goods or services.
5.2 Conditional 14-Day Guarantee – Notion System & E-Books
Earthkey Media believes in the value of our digital products. For first-time purchasers of the Intentional Social Media Notion system or any e-book, we offer a Conditional 14-Day Money-Back Guarantee.
To be considered for a refund under this guarantee, you must:
- Email info@earthkeymedia.com before 11:59 pm CET on the 14th day after your purchase date
- Include your full name, purchase email address, and proof of genuine engagement with the product (e.g., a screenshot showing you have set up the Notion template and attempted to use it, or evidence you have read a meaningful portion of the e-book)
- Provide a brief explanation of why the product was not suitable for your needs
Requests are reviewed at Earthkey Media’s sole discretion. Approved refunds will be processed to the original payment method within 30 days of approval. If your request is denied, you remain responsible for the full purchase price.
5.3 Non-Qualifying Situations
Refunds will not be granted for:
- Change of mind or personal circumstances after the guarantee window
- Failure to access, use, or engage with the product
- Dissatisfaction where the product matches its description and you have not shown evidence of genuine use
- Requests made after the stated refund window has closed
- Done-for-you services (social media management, branding) where work has commenced
5.4 Done-For-You & Retainer Services
No refunds are available for social media management or branding services once work has commenced. Where a retainer is cancelled in accordance with Section 7.3, fees already paid for the current service period are non-refundable.
5.5 Payment Plan Obligations
If a refund request is denied, you remain financially responsible for all remaining instalments in any active payment plan.

6.1 Digital Products
E-books and the Notion system are delivered digitally via a download link or Notion duplication link within 24 hours of confirmed payment. You are responsible for saving and retaining downloaded files. Earthkey Media is not responsible for files lost due to your device or storage failures.
6.2 Access Duration – Digital Products
Digital products include a minimum of 12 months of access from the date of purchase, unless stated otherwise at checkout. Where “lifetime access” is stated, this refers to the lifetime of the product – meaning the period during which it is actively offered and maintained by Earthkey Media. Earthkey Media may retire or update a product at any time with at least 30 days’ notice to affected purchasers.
6.3 Service Delivery – Social Media Management & Branding
Timelines, deliverables, and milestones for done-for-you services are agreed upon in writing at the start of each engagement. Earthkey Media will make reasonable efforts to meet agreed timelines, subject to timely receipt of required materials, approvals, and information from you.
6.4 Delays Caused by Client
Earthkey Media is not liable for delays caused by your failure to provide content, feedback, approvals, or access credentials in a timely manner. Where significant client delays occur, project timelines and retainer periods may be adjusted accordingly.
6.5 Content Updates
Earthkey Media may update, revise, or replace digital product content at any time to reflect best practices, platform changes, or improvements. You will receive access to updated versions of purchased products during your active access period where applicable.

7.1 Provision of Materials
For social media management and branding services, you are responsible for providing Earthkey Media with all necessary materials, brand assets, login access, approvals, and information required to deliver the Services, in a timely manner and as agreed at the start of the engagement.
7.2 Account Access
Where Earthkey Media requires access to your social media accounts or third-party platforms to deliver Services, you are responsible for granting appropriate access and ensuring that access remains active throughout the service period. EarthKey Media will not be responsible for disruptions caused by your removal of access or changes to platform permissions.
7.3 Cancellation of Retainer Services
Either party may cancel an ongoing retainer arrangement with a minimum of 30 days’ written notice by email to info@earthkeymedia.com . Notice periods begin from the date the email is received and acknowledged. Fees for the current 30-day notice period are payable in full regardless of whether you continue to use the Services during this period.
7.4 Legal Compliance
You are solely responsible for ensuring that any content, materials, or instructions you provide to EarthKey Media comply with all applicable laws, including advertising regulations, intellectual property laws, data protection laws (including GDPR), and any applicable platform terms of service. Earthkey Media will not publish content that it reasonably believes to be unlawful, misleading, defamatory, or in breach of platform guidelines.
7.5 Social Media Platforms
You acknowledge that social media platforms (Instagram, TikTok, LinkedIn, Facebook, Pinterest, YouTube, and others) may change their algorithms, features, or policies at any time. Earthkey Media makes no guarantee of specific reach, engagement, follower growth, or other performance metrics, as these depend on platform behaviour and factors outside our control.

8.1 Third-Party Platforms
Earthkey Media Services rely on or reference third-party platforms including but not limited to Notion, Instagram, TikTok, Facebook, LinkedIn, Pinterest, YouTube, Canva, scheduling tools, and payment processors (“Third-Party Platforms“). Use of these platforms may require you to create and maintain your own accounts.
8.2 No Liability for Third-Party Changes
Earthkey Media is not responsible for:
- Downtime, outages, or interruptions on Third-Party Platforms
- Removal or modification of features by a Third-Party Platform
- Suspension or restriction of your account on a Third-Party Platform
- Policy or algorithm changes that affect the performance or delivery of agreed Services
Where a platform change materially impacts our ability to deliver a specific Service, Earthkey Media will notify you and, where possible, propose an alternative approach. This does not entitle you to a refund where the core Services remain deliverable.
8.3 Notion Dependency
The builded Notion system requires a Notion account (free or paid) to access and use. Earthkey Media is not responsible for any changes to Notion’s pricing, features, or availability. Use of Notion is subject to Notion’s own terms of service.

By using our Services, you consent to:
- The collection and processing of personal data necessary to provide the Services and manage our business relationship with you, on the lawful basis of contract and legitimate interests
- Receiving transactional communications related to your purchase or active Services
- Receiving marketing communications where you have given separate consent (you may withdraw this consent at any time by emailing info@earthkeymedia.com)
- The secure storage of your account and transaction information for the period necessary to fulfil the contract and comply with legal obligations
EarthKey Media does not sell your personal data to third parties. Data may be shared with trusted service providers (e.g., payment processors, email platforms) where necessary to deliver the Services, subject to appropriate data processing agreements.
You have the right to access, rectify, erase, restrict, or port your personal data, and to object to its processing. To exercise these rights, please email info@earthkeymedia.com.

10.1 Consent to Use
By participating in any Earthkey Media Service, you acknowledge that feedback, results, comments, or statements you share – whether via email, social media, testimonial forms, or direct communication with Earthkey Media – may be collected and used for marketing and educational purposes.
10.2 License Granted
You grant EarthKey Media a worldwide, non-exclusive, royalty-free licence to use, reproduce, and display your testimonial or feedback in whole or in part, in any media format, for marketing and promotional purposes. Your first name and general business context are not used by itself and may be included when consent is given by you in written form.
10.3 Recorded Sessions
Where strategy sessions or calls are recorded, this will be communicated at the start of the session. Recordings are used for internal quality purposes and/or to provide you with a replay. Earthkey Media will not use recordings of private client sessions in public marketing materials without your explicit written consent.
10.4 No Compensation
You will not receive payment or additional services in exchange for Earthkey Media’s use of your testimonial or feedback.

Where EarthKey Media provides access to any community space, group environment, or shared resource (e.g., a Notion community workspace, private group, or online forum), participants agree to:
- Treat all participants and EarthKey Media team members with respect and professionalism
- Maintain confidentiality of any peer discussions, personal stories, or strategies shared within group settings
- Refrain from unsolicited promotion, spam, or recruitment within shared spaces
- Respect the intellectual property of Earthkey Media and fellow participants
Earthkey Media reserves the right to remove any participant from a shared space without refund if their conduct violates these standards or disrupts the environment.

12.1 Educational & Informational Purpose
All Earthkey Media products, services, and materials are provided for educational, informational, and strategic support purposes only. Nothing in our Services constitutes legal, financial, medical, or other professional advice. Always consult a qualified professional before making significant business or financial decisions.
12.2 No Guarantee of Results
Earthkey Media does not guarantee specific results – financial, business, social media growth, or otherwise – from your use of our Services. Any examples, case studies, or client results referenced are illustrative only. Your results will depend on your individual circumstances, effort, market conditions, and factors outside Earthkey Media’s control.
12.3 Social Media & Platform Disclaimer
Earthkey Media makes no guarantee of specific reach, engagement, follower growth, conversion rates, or revenue as a result of social media management services. Platform algorithms and performance are outside our direct control.
12.4 Assumption of Risk
All decisions made based on information or content provided by Earthkey Media are made at your own risk. You accept full responsibility for your actions and any resulting outcomes.
12.5 Accuracy of Content
Earthkey Media makes reasonable efforts to ensure that all content, templates, and resources are accurate and up to date. However, social media platforms, tools, and best practices change frequently. We do not warrant that any content will be accurate, complete, or current at the time of your use.

13.1 Maximum Liability
To the fullest extent permitted by applicable law, Earthkey Media’s total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount you actually paid to Earthkey Media for the specific Service giving rise to the claim in the three (3) months preceding the claim.
13.2 Excluded Damages
Earthkey Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of revenue or profits; loss of data or business opportunity; reputational damage; or claims by third parties arising from your actions or use of the Services.
13.3 Consumer Rights
Nothing in these Terms limits or excludes Earthkey Media’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable EU or UK consumer protection law.
13.4 Force Majeure
Earthkey Media shall not be held liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, public health emergencies, internet or platform outages, war, government actions, or other force majeure events.

14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Republic of Estonia. If you are a consumer resident in another EU member state or the UK, you also benefit from any mandatory protections afforded by the laws of your country of residence.
14.2 Good Faith Resolution
In the event of a dispute, both parties agree to first attempt resolution in good faith through written communication. Please send a detailed description of the issue to info@earthkeymedia.com . Earthkey Media will aim to respond within 10 business days.
14.3 Formal Dispute Resolution
If a dispute cannot be resolved informally, it shall be referred to the competent courts of Supreme Court of Estonia. EU consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14.4 Limitation Period
Any claim or cause of action arising from these Terms or the Services must be filed within two (2) years of the date it arose, to the fullest extent permitted by applicable law.

15.1 Right to Modify
Earthkey Media reserves the right to update or revise these Terms at any time to reflect changes to our Services, legal requirements, or business operations.
15.2 Notice of Material Changes
For material changes (e.g., to refund policies or core service obligations), Earthkey Media will notify you by email to your address on file and/or by prominent notice on the website at least 14 days before the changes take effect.
15.3 Continued Use
Your continued use of the Services after notice of changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, your sole remedy is to discontinue use of the Services and cancel any active subscriptions in accordance with Section 7.3.

16.1 Response Times
Earthkey Media aims to respond to all enquiries within 2–3 business days, excluding weekends and public holidays. Complex issues may take longer.
16.2 Scope of Support
Standard support covers access to purchased Services, clarification of content, and general account queries. It does not include personalized business consulting or strategy unless expressly included in your purchased Service.
